Terms of Service

These Terms of Service ("Terms") govern your access to and use of HeartTraxIQ (the "Software"). By creating an account or otherwise using the Software, you agree to these Terms. If you do not agree, do not use the Software.

1. Description of the Software

HeartTraxIQ is personal record-keeping software intended to help users track vitals, blood glucose, medications, and related health information for their own reference, and to optionally sync readings from supported third-party devices and services (such as Withings and Google Health). The Software may add, change, or remove features at any time.

2. Not Medical Advice

The Software is for informational and personal record-keeping purposes only. It is not a medical device and is not a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition, and never disregard professional medical advice or delay seeking it because of something you tracked, read, or calculated using the Software. Do not use the Software to request emergency help - call your local emergency services for urgent situations.

3. Eligibility and Accounts

You must be able to form a binding contract to use the Software. You are responsible for maintaining the confidentiality of your sign-in credentials and for all activity that occurs under your account. Notify us promptly if you believe your account has been accessed without authorization.

4. Acceptable Use

You agree not to misuse the Software. This includes, without limitation: attempting to gain unauthorized access to any account, system, or data; interfering with or disrupting the integrity or performance of the Software; uploading or entering unlawful, harmful, or infringing content (including in the Message Board feature); reverse-engineering the Software except as permitted by law; or using the Software in a way that violates any applicable law or regulation.

5. Your Content

You retain ownership of the information you enter into the Software ("Your Content"), including vitals, medication notes, blood glucose readings, and message board posts. You are solely responsible for Your Content and for ensuring you have the right to share anything you post, including in shared or community-visible areas such as the Message Board. We may remove content that violates these Terms.

6. Third-Party Device Integrations

If you choose to connect a third-party account or device (such as Withings or Google Health), you authorize the Software to retrieve and store the health data made available by that connection on your behalf. Your use of those third-party services remains subject to their own terms and privacy policies. We are not responsible for the accuracy, availability, or completeness of data provided by third-party services, or for outages or changes to their APIs that may affect syncing.

7. Intellectual Property

The Software, including its design, features, and underlying code, is owned by the application owner and is protected by applicable intellectual property laws. Except for Your Content, you receive no ownership rights in the Software. You may not copy, modify, distribute, sell, or lease any part of the Software except as expressly permitted.

8. Disclaimer of Warranties

THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR AVAILABILITY. We do not warrant that the Software will be uninterrupted, secure, or error-free, or that any data (including data synced from third-party devices) will be accurate or complete.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, THE APPLICATION OWNER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, HEALTH OUTCOMES, OR PROFITS, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SOFTWARE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you.

10. Support and Availability

Ongoing support, uptime, and response times are not guaranteed unless separately agreed in writing. Documentation may be provided, but dedicated support is not guaranteed.

11. Termination

You may stop using the Software and request deletion of your account at any time. We may suspend or terminate your access to the Software if we reasonably believe you have violated these Terms or if continued access could create risk or liability. Provisions that by their nature should survive termination (including disclaimers and limitations of liability) will survive.

12. Changes to These Terms

We may update these Terms from time to time. Continued use of the Software after an update means you accept the revised Terms. If changes are material, we will make reasonable efforts to provide notice within the Software.

13. Governing Law

These Terms are governed by the laws applicable in the jurisdiction in which the application owner operates, without regard to conflict of law principles, except where applicable law requires otherwise.
